Ethical Requirements and Management Standards for the Sharing and Re-use of Scientific Data in Healthcare and Medicine(X) Suggestions on the Solution of Property Right and Owership for Big Data

The property rights and their ownership of data is the basis of rights and interests’ distribution during data sharing and applications.It is an important problem to be solved for sustainable data sharing. At present,there is a lack of recognized solutions to identify the property rights of data, especially big data in healthcare and medicine. According tothe author, big data has possessed the attributes of commodity and property rights.A potential solution of the cognizance and ownership of property rights for big data in healthcare and medicineunder the legal framework of existing property rights(including intellectual property rights)was suggested. The ownership of personal data and integrated data should be clearly stipulated by law. In addition, the corresponding property rights of big data should be defined or authorized through detailed rules. To big data in healthcare and medicine, ethical factors should be consideredin identification of property rightsand legal resrictions on these rights, so as to balance between individual interests and social public welfare.
