The article of a paradigm shift related to the of people disabilities. The Convention on the Rights of Persons with Disabilities, the Disabled Persons Statute and the Approach to Capacities theory are the theoretical foundations used to develop the argument that the person with mental or intellectual disability has the civil capacity to carry out acts of business management and assume the responsibilities arising therefrom, on an equal basis with other persons. Therefore, through a bibliographical and exploratory methodology, due to the scarcity of texts until then produced. The doctrine that still uses vulnerability and disability as modulators of the civil capacity of the person with the disability is criticized, and it is proposed to extend the vision on the theme for a look of insertion and stimulus to entrepreneurship.
