4차 산업혁명(fourth industrial revolution: 4IR)은 3차 산업혁명의 연장선에서 시작하여, 특히 정보통신기술의 발달로 인하여 4차 산업혁명이 도래하게 되었다[1]. 4차 산업혁명의 핵심요소는 개별적으로 발전한 각종 기술들이 ‘융합’하면서 컴퓨터의 소프트웨어를 기반으로 한 인공지능(AI)이 그 중심에 섰다[2][3][4].
4차 산업혁명이 가져올 AI시대가 우리사회에 미칠 영향은 우리의 상상력을 뛰어 넘어설 것으로 전망된다[1][2]. 인간이 기술중심사회문화를 경험할 악사 아 용변하고 있으며, 지능정보사회인 4차 산업혁명의 AI시대는 AI로봇과 공존하는 사회가 될 것이다[2]. AI시대에는 로봇이 사람의 일을 대신하고 함으로써 여가시간을 늘려 줄 수 있게 될 것이기 때문에 인류의 삶은 더욱 더 풍요롭게 할 수 있다는 스마트사회가 될 것이다[2][5][6].
인공지능은 머지않아 인간을 위한 보조수단을 벗어나 인간을 대체하는 수단으로 빠르게 성장할 것으로 전망된다[5]. 언론에도 인공지능이 대체하게 될 직업을 순위를 매겨 보도하기도 한 바 있는데, 우리를 불안케 한 것은 판사, 변호사, 의사와 같은 법률 또는 의학과 같은 전문직업을 대체할 것으로 언급하고 있다[7][8]. 이와 같은 인공지능에 관한 눈부신 발전에 의하여 국내외 법조계에서도 변화의 바람이 거세게 불고 있다[9][10]. 법률정보를 리서치 하는 프로그램과 판례검색 시스템, 법률통계에 관한 빅데이터 처리 시스템 등 인공지능이 접목된 시스템이 이미 개발돼 상용화 되고 있거나 개발이 진행되고 있다[4][11]. 이러한 기술을 전담할 ‘인공지능 법’ 분야도 탄생이 가능한 것이라는 관측도 제기되고 있다[9].
4차 산업혁명의 AI시대에 논의되고 있는 쟁점은 학계 · 산업계에서의 관점 학과 과제와 전망, 그리고 AI시대에 도래할 지능정보사회로서 스마트사회의 대란 전망을 AI로봇을 중심으로 살펴보았다[1][2]. 향후 지능정보사회의 도래에 따라 AI가 만들어 낸 창작물에 대한 법적 쟁점을 논의했으며, 사람을 대신해서 일기지를 보충해줄 로봇의 법적 지위에 대한 법적 안정성을 고려해 법인격을 부여하는 문제, AI가 저작자 내지 발명자의 지위에서 지식재산권 관련 문제, 로봇의 규제와 윤리에 관한 문제 등에 대해 현행법의 해석론을 중심으로 고찰하였으며, 법의 공백상태에 있는 쟁점에 관해서는 입법론을 개진하였다[9][9][9][10][11][12][13][14][15][16][17].
